Purchase rules

  •  1. CONCEPTS

     

    1.1. Rules shall mean the terms and conditions of the purchase and sale agreement.

    1.2. Online Store shall mean the store located on the aimyoustyl.lt website.

    1.3. Seller shall mean UAB AIMYOUSTYL, registered and operating according to the laws of the Republic of Lithuania, company code 305727800, VAT identification number LT 100013944810, registered office address Žemaitės st. 21-102, LT-03118 Vilnius, the Republic of Lithuania, e-mail address info@aimyoustyl.lt, bank account No. LT077044090102472177, SEB bankas, SWIFT code (BIC) CBVILT2X, bank code 70440.

    1.4. Buyer shall mean the user of the Online Store.

    1.5. Purchase and Sale Agreement shall mean the purchase and sale agreement of products concluded between the Seller and the Buyer, which consists of an electronic order form, the Rules and the Privacy Policy.

    1.6. Account shall mean the result of the Buyer's registration in the Online Store, which creates an account that stores the data provided by him/her in the electronic order form (hereinafter referred to as the order), the electronic return form, data about orders in the Online Store, Account login data. 

    1.7. Privacy Policy shall mean the terms of processing personal data.

     

    2. SUBJECT-MATTER

     

    In the Purchase and Sale Agreement, the Seller undertakes to sell and deliver the products to the Buyer, and the Buyer undertakes to accept the products and pay the price determined for it and the shipping fee, under the terms and conditions stipulated in the Rules.

     

    3. BUYER'S RIGHTS

     

    3.1. The Buyer shall have the right to buy products in the Online Store.

    3.2. The Buyer shall have the right to cancel the Purchase and Sale Agreement by returning the product to the Seller.

     

    4. BUYER'S OBLIGATIONS

     

    4.1. The Buyer, who has placed an order in the Online Store, shall have the obligation to pay the price of the product and the shipping fee.

    4.2. The Buyer, who has placed an order in the Online Store, shall have the obligation to accept the product.

    4.2. The Buyer shall have the obligation not to transfer his/her login data to the Online Store to third parties.

     

    5. SELLER'S RIGHTS

     

    5.1. The Seller shall have the right to cancel the Buyer's order if the Buyer does not pay the price of the product and/or the shipping fee within 2 (two) business days (the payment is not credited to the Seller's bank account), by notifying the e-mail address specified by the Buyer. 

    5.2. The Seller shall have the right to change the price of the product and the shipping fee without prior notice, except for those specified in the electronic order form submitted by the Buyer. 

     

    6. SELLER'S OBLIGATIONS

     

    6.1. The Seller shall have the obligation to enable the Buyer to use the Online Store.

    6.2. The Seller shall have the obligation to provide the ordered product to the Buyer.

    6.3. After the Buyer returns the product, the Seller shall have the obligation to return the money paid by the Buyer (the price of the product) to the Buyer's bank account from which the product was paid for, except if the payment was made in a different way than specified in Clause 9.5. of the Rules. 

     

    7. CONCLUSION OF THE PURCHASE AND SALE AGREEMENT

     

    7.1. The Buyer may buy a product in the Online Store through an Account or without an Account in the Online Store system.

    7.2. After completing the electronic order form, the Buyer shall submit it to the Seller through the Online Store system. The product shall be considered ordered when the Buyer receives confirmation at the e-mail address specified by him/her.

    7.3. In the electronic order form, the Buyer's name, Buyer's surname, Buyer's address, Buyer's e-mail address, Buyer's telephone number, the discount code (if applicable), the method of sending the product, and the fact that they are familiar with the Rules and the Privacy Policy must be indicated.

     

    8. PRODUCT

     

    The characteristics of the product shall be specified in the description attached to the product in the Online Store. 

     

    9. PRODUCT PRICE, SHIPPING FEE, PAYMENT

     

    9.1. The price of the product in the Online Store and in the electronic order form shall be indicated in euros with VAT before the Buyer submits the electronic order form. 

    9.2. The shipping fee in the Online Store and in the electronic order form shall be indicated in euros before the Buyer submits the electronic order form. Shipping fee shall apply to each order.

    9.3. The invoice shall be sent to the e-mail address specified by the Buyer.

    9.4. Payment shall be made using electronic banking by direct transfer through any bank of the Republic of Lithuania or using a payment card.

    9.5. Monetary transactions shall be carried out in the electronic banking system of the bank AB SEB bankas through the Online Store.

    10. DISCOUNT CODE

     

    10.1. The discount code shall be applied under the terms and conditions specified by the Seller with the discount code provided in the Online Store.

    10.2. The discount code shall not apply to the product the price of which has been reduced.

    10.3. One discount code may be applied to each order.

     

    11. SENDING, RECEIPT OF THE PRODUCT

     

    11.1. The products shall be available for shipment within 1 – 5 (one – five) business days from the day of crediting the payment to the Seller's bank account. 

    11.2. The products shall be delivered through DPD Pick up self-service terminals or DPD parcel service at the Buyer's choice.

    11.3. The products shall be delivered within 1 – 4 (one – four) calendar days in the Republic of Lithuania. Products outside the Republic of Lithuania shall be delivered within 4 – 9 (four – nine) calendar days.

    11.5. The Seller shall be released from liability for the violation of the deadline for the delivery of the products, if the products are not delivered to the Buyer or are not delivered by the specified deadlines due to circumstances beyond the control of the Buyer.

    11.6. When accepting the consignment, the Buyer must check the condition of the consignment (whether the outer packaging is not damaged). After the Buyer accepts the product, the transferred consignment shall be considered to be in good condition.

     

    12. RETURN OF PRODUCTS 

     

    12.1. The product may be returned by the Buyer without specifying the reasons within 14 (fourteen) calendar days from the day of receiving the product, sending it to the Seller. 

    12.2. The Buyer must fill out the electronic return form, which the Buyer must then submit to the Seller through the Online Store. The electronic return form must contain the Buyer's name, Buyer's surname, Buyer's e-mail address, Buyer's telephone number, order number, product, method of product return (DPD Pick up self-service terminal or parcel service). If the payment is made in a different way than specified in Clause 9.5. of the Rules, the Buyer shall indicate the Buyer's bank account number and bank details. The Buyer may indicate the reason for the return of the product (except for Clause 13.5. of the Rules).

    12.3. The returned product must meet the following characteristics:

    12.3.1. must be in neat packaging;

    12.3.2. its appearance must not be changed (undamaged, unworn);

    12.3.3. the labels must be intact.

    12.4. The product shall be returned through the DPD Pickup self-service terminal or the parcel service at Žemaitės st. 21-102, LT-03118 Vilnius, the Republic of Lithuania at the Buyer's choice. 

    12.5. The product shall be returned free of charge through DPD Pick up self-service terminals in the Republic of Lithuania. When returning the product by other means, the Seller shall not compensate the Buyer for the costs of returning the product.

    12.6. The Seller shall return the price of the products to the Buyer to the Buyer's bank account no later than within 5 (five) business days from the day of receipt of the returned products. 

     

    13. LIABILITY

     

    13.1. If the Buyer violates the Rules, the Seller shall have the right to limit the Buyer's access to the Online Store and cancel the Account without prior notice.

    13.2. If the Seller does not deliver the product within the terms specified in the Rules, the Buyer may cancel the order by notifying the Seller's e-mail address before its delivery. If the Seller agrees with the Buyer, the Seller shall refund the price of the products and the shipping fee to the Buyer's bank account no later than within 5 (five) business days from the date of receipt of the notification. If the Seller does not agree with the Buyer, the Seller shall return the price of the product to the Buyer's bank account no later than within 5 (five) business days from the day of receipt of the unaccepted product. The Buyer shall reimburse the Seller for proven, reasonable expenses related to the return of the products based on the supporting evidence provided by the Seller no later than within 5 (five) business days from the date of receipt of the request.

    13.3. If the Buyer does not pick up the product according to the chosen delivery method, the product shall be returned to the Seller and the Buyer's order shall be canceled, notifying the Buyer thereof by the e-mail address specified by the Buyer. The Seller shall return the price of the product to the Buyer's bank account no later than within 5 (five) business days from the day of receipt of the unclaimed product. The Buyer shall reimburse the Seller for proven, reasonable expenses related to non-receipt of the products based on the supporting evidence provided by the Seller no later than within 5 (five) business days from the date of receipt of the request.

    13.4. If the Seller presents a product that does not meet the characteristics specified in Clause 12.3.1. of the Rules, the Buyer shall not accept the product and cancel the order by notifying the Seller's e-mail address no later than on the day of non-acceptance of the product, attaching supporting evidence and evidence confirming the costs of non-acceptance of the product. If the Seller agrees with the Buyer, the Seller shall return the price of the product, the shipping fee to the Buyer no later than within 5 (five) business days from the day of receipt of the non-accepted product, and reimburse the proven, reasonable expenses related to the non-acceptance of the product by paying them to the Buyer's bank account. If the Seller does not agree with the Buyer, the Seller shall return the price of the product to the Buyer's bank account no later than within 5 (five) business days from the day of receipt of the unaccepted product.

    13.5. If the Seller presents a product that does not meet the characteristics specified in Clauses 8., 12.3.2., 12.3.3. of the Rules, the Buyer shall return the product in accordance with the procedure for returning products provided in the Rules. The Buyer shall notify the Seller at the e-mail address no later than the day of dispatch of the product about the relevant circumstances, attaching supporting evidence and evidence confirming the costs of returning the product. Upon the Seller's agreement with the Buyer, the Seller shall return the price of the product, the shipping fee to the Buyer no later than within 5 (five) business days from the day of receipt of the returned product and compensate the proven, reasonable costs of returning the product by paying them to the Buyer's bank account. When returning part of the products, the shipping fee shall not be refunded to the Buyer. If the Seller does not agree with the Buyer, the Seller shall refund the price of the product to the Buyer by paying to the Buyer's bank account no later than within 5 (five) business days from the day of receipt of the returned product.

    13.6. If the Buyer returns a product that does not meet at least one of the characteristics specified in Clauses 12.3.2., 12.3.3. of the Rules, the Seller shall notify the Buyer at the e-mail address provided by the Buyer no later than within 5 (five) business days from the day of receipt of the product, attaching supporting evidence. The Seller shall not refund the price of the product and the shipping fee to the Buyer. The Buyer shall reimburse the Seller for proven, reasonable expenses related to the return of the products based on the supporting evidence provided by the Seller no later than within 5 (five) business days from the date of receipt of the request.

     

    14. PROCESSING OF PERSONAL DATA

     

    The personal data provided by the Buyer shall be processed under the terms and conditions specified in the Privacy Policy.

     

    15. INTELLECTUAL PROPERTY

     

    15.1. All rights to the Online Store shall be reserved. The content of the Online Store cannot be distributed in any form without the written consent of the Seller.

    15.2. All trade marks that are presented in the Online Store shall be considered to be the property of the Seller or shall legally used by it.

     

    16. FINAL PROVISIONS

     

    16.1. By submitting an electronic order form through the Online Store, the Buyer hereby confirms that he/she has read and agrees with the Rules. 

    16.2. Changes to the Rules shall take effect from the day of their publication by announcing them in the Online Store. The latest version of the Rules valid at the time of placing the order shall apply. 

    16.3. Disputes related to the Purchase and Sale Agreement shall be resolved in a pre-trial procedure by submitting a claim, which shall be examined within 5 (five) business days from its receipt, and if it cannot be resolved, it shall be examined in the Court of the Republic of Lithuania, in the city of Vilnius, in accordance with the law of the Republic of Lithuania. 


    PRIVACY POLICY 

     

    1. The Seller shall ensure the rights of the Buyer in accordance with the legal acts governing the processing of personal data. 

     

    2. The Seller shall receive personal data directly from the Buyer. The Seller shall not process personal data obtained in other ways.

     

    3. When the Buyer uses the Online Store, it shall be considered that the Buyer agrees with the Privacy Policy.

     

    4.1. The Seller shall process the Buyer's personal data for the purposes of account registration and order fulfilment.

    4.2. The Seller shall process the Buyer's personal data for the purposes of submitting offers. 

    4.3. The Seller shall use cookies for the purpose of analysing the Buyer's behaviour and traffic.

     

    5.1. The Seller shall process the following personal data of the Buyer for the purposes of account registration and order fulfilment: Buyer's name, Buyer's surname, Buyer's address, Buyer's e-mail address, Buyer's telephone number, Buyer's bank account details, method of delivery of products, account login data, actions taken in the Account, including technical browsing data (IP address, login and browsing technical information), order number, dates and times related to the execution of the order, product name, quantity, product price, shipping fee, discount granted, payment-related data, reason for returning the product, amounts paid to the Buyer/origin thereof, signature, indication that the Buyer has gotten acquainted with the Rules, the Privacy Policy, information provided in the application: the event in regards to which the Buyer is applying and the circumstances related thereto, attached evidence.

    5.2. The Seller shall process the following personal data of the Buyer for the purposes of submitting offers: Buyer's name, Buyer's surname, Buyer's e-mail address.

    5.3. The Seller shall process the following personal data of the Buyer for the purposes of analysing the Buyer's behaviour and traffic: actions in the Account, technical browsing data (IP address, login and browsing technical information).

     

    6.1. Personal data required for account registration shall be processed as long as the Buyer's account is active. 

    6.2. Personal data required for the fulfilment of the order shall be processed until the fulfilment of the order is completed (or the request is processed, depending on which term is longer). Accounting documents shall be stored in accordance with the terms provided for in legal acts. 

    6.3. Personal data required for the submission of proposals shall be processed for 3 years from the date of their receipt.

    6.4. Other personal data shall be processed for 3 years from the date of their receipt.

     

     

    7. The Seller may provide the Buyer's personal data to the following data recipients:

    7.1. companies providing software maintenance and support services;

    7.2. shipping companies;

    7.3. payment service companies;

    7.4. as well as other recipients of data when, according to legislation, the Seller is obliged to provide personal data.

     

    8. The Seller undertakes to ensure the security of the Buyer's personal data, to implement appropriate technical and organisational measures to protect personal data from unlawful destruction and/or accidental change, disclosure and from any other unlawful processing. 

     

    9. The Buyer shall have the right to get acquainted with his/her personal data and how they are processed, to request correction, addition or destruction of the submitted personal data (withdraw consent). 

     

    10.1. Changes to the Privacy Policy shall take effect from the date of their publication by posting them in the Online Store. The latest version of the Privacy Policy shall apply. 

    10.2. Disputes related to the Privacy Policy shall be resolved in a pre-trial procedure by submitting a claim, which shall be examined within 5 (five) business days from its receipt, if it cannot be resolved, it shall be examined in the court of the Republic of Lithuania, in the city of Vilnius, in accordance with the law of the Republic of Lithuania.
